Organizational conflicts of interest (OCI) are a perplexing and confusing aspect of Government contracting, and experts agree that the current regulations are sorely in need of an overhaul. Although the Office of Federal Procurement Policy issued proposed new regulations on this important topic in 2011, they have yet to be finalized. In the meantime, the courts and the Government Accountability Office have attempted to apply and interpret the existing OCI rules, with mixed results. Consequently, contractors and agency personnel alike continue to wrestle with this thorny problem. Join Professor Ralph Nash and Tim Sullivan as they discuss the various OCI issues, the stream of protest decisions dealing with those issues, and the lessons to be learned from them.
